Unfair dismissal help in South Africa

Dismissed? Start with the date.

The dismissal date, any internal appeal outcome and the stated reason affect what happens next. Record them before messages, documents and deadlines become harder to manage.

Take these first steps now.

Record the final dateNote when employment ended and when any internal appeal decision was communicated.
Keep the stated reasonSave the dismissal outcome, termination notice and the allegation, capacity issue or operational reason given.
Check the forumIdentify the employer's full name and sector so you can confirm whether the CCMA or a Bargaining Council has jurisdiction.

The common referral window is short.

The CCMA states that an unfair dismissal dispute generally must be referred within 30 days of dismissal, or within 30 days of a later final decision that upholds the dismissal after an internal appeal. A late referral generally needs a condonation application. Confirm the current rule and correct forum for your facts immediately.

Build a dismissal record that another person can follow.

TimelineList the key events in date order: notice, hearing or consultation, outcome, appeal and final working day.
DocumentsKeep the contract, policies, notices, minutes, warnings, outcome letter, appeal result, payslips and relevant messages.
Fairness questionsSeparate what reason the employer relied on from how the employer followed its procedure. Do not assume either point proves the other.

Common mistakes: waiting for a complete file before checking the deadline, using an informal employer name on the referral, sending an emotional narrative without dates, or assuming an internal appeal pauses every time limit.

Know what may happen after referral.

Conciliation is an attempt to resolve the dispute. If the matter remains unresolved, the next route can depend on the reason for dismissal, the forum's jurisdiction and whether con-arb applies. Do not assume every dismissal follows the same hearing path.

Do not wait for every document before acting.

Start with the dismissal date, employer, industry and outcome letter. Missing documents can be identified during the assessment.
