1. Service Description

DigiLinx Advisory provides CCMA, disciplinary, and workplace process support (collectively "the Services") to South African employers, managers, and employees. The Services include document review, preparation support, process guidance, evidence organisation, hearing preparation, and support with representation only where permitted and appropriate.

DigiLinx Advisory is not a law firm. We do not provide legal advice or legal representation in the traditional sense. Our Services are practical, process-oriented support designed to help you navigate workplace processes. For complex or high-stakes matters, we recommend seeking independent legal advice.

Important: No outcome can be guaranteed. Results depend on the specific facts, circumstances, and conduct of each matter. Past outcomes (including those referenced in marketing or testimonials) are not indicative of future results.

3. Payment Methods

We accept payment via EFT (electronic funds transfer), PayFast (credit card, instant EFT, SnapScan), and Yoco card payments. Full payment must be received before Services commence unless otherwise agreed in writing.

4. Refund Policy

Consulting Services

Refunds for consulting services are assessed on a case-by-case basis. If we are unable to proceed with a matter after engagement, we will refund any unused portion of the fee. No refunds are given for services already rendered (including strategy calls, document reviews, or hearing preparation).

Digital Products

Due to the nature of digital products (instant download), all sales of digital products are final and non-refundable. Please review the product description carefully before purchasing.

Retainers

Retainer fees are non-refundable once the retainer cycle has commenced. If DigiLinx Advisory terminates the retainer agreement, a pro-rata refund will be issued for the remainder of the cycle.

Information We Collect

We collect information you provide directly: name, contact details, employment information, matter details, and any documents you share for the purpose of providing our Services.

How We Use Your Information

Data Protection

All matter-related information is treated as confidential. We implement appropriate technical and organisational measures to protect your data. We do not share your information with third parties except as required to provide our Services (e.g., PayFast for payment processing) or as required by law.

Data Retention

We retain matter files for the duration of the engagement plus 3 years thereafter, after which they are securely archived or destroyed per our data retention policy.

Your Rights

You have the right to request access to, correction of, or deletion of your personal information held by us, subject to applicable law.

6. Confidentiality

All information shared with DigiLinx Advisory in connection with a matter is treated as confidential. We will not disclose matter details without your consent, except as required by law or legal process. Please note that communications via email, WhatsApp, or other electronic means are not guaranteed to be privileged in the same manner as communications with a legal practitioner.

7. Limitation of Liability

DigiLinx Advisory provides process support and guidance only. We do not guarantee any specific outcome. To the maximum extent permitted by law, DigiLinx Advisory's liability for any claim arising from the Services is limited to the fees paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages.

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or the Services shall be subject to the jurisdiction of the courts of South Africa.

10. Changes to This Policy

We may update these terms from time to time. Material changes will be communicated via email or through our website. Continued use of our Services after changes constitutes acceptance of the updated terms.
